In plain words

The full text is in English and is the version that applies. This summary is here to help you read it.

  • Rollagain is an app that finds you an independent mechanic, locks one price before any work, holds that amount on your card, and keeps photos, times and GPS on record. Rollagain does not do the repair and does not guarantee it. The mechanic is their own business, not our employee. Until Rollagain LLC exists, KNAM Media runs the service under the Rollagain name.
  • Not an emergency service and not a tow. If anyone is hurt or in danger, call 911. We do not send mechanics onto the mainline or shoulder of toll roads and controlled highways; the app sends you to the road’s own service. If dispatch gives you a tow company’s number, that company is independent and you pay it directly.
  • Your card is held, not charged, when you approve. Nothing can be added to the price without your new approval. Your bank may show the hold as “pending” for a few days. If the hold lapses before the job is confirmed, you allow us to place it again or to charge your card for the same amount.
  • You are charged when you confirm the vehicle is rolling, or automatically 24 hours after the mechanic marks the job done if you neither confirm nor report a problem. Then the mechanic is paid.
  • Something wrong? Tap “Something is wrong” before those 24 hours end. The money stays held. Rollagain decides on the record (photos, times, GPS), normally within 48 hours; that decision is final for that job’s money. Please do this before calling your bank.
  • Not fixable where the truck stands: you pay only the diagnostic line of your price, if there is one, plus its share of any sales tax line, and nothing else.
  • Cancelling: free any time before you approve, free until two hours before a booked visit, and free if the mechanic is more than 15 minutes past the arrival time on the quote. After you approve a help-now job you cancel through dispatch; only the travel line on your quote (before arrival) or the diagnostic line (after arrival) can be charged, if your quote has one.
  • Texts: if you tick the box, or give your number on the form or to the phone assistant, we text you about your jobs. Message frequency varies; message and data rates may apply. Reply STOP to stop, HELP for help, or write to support@rollagain.app. Texts are not required; everything still shows in the app. Calls to our number are answered by an automated assistant and are recorded and transcribed; say “dispatcher” to reach a person.
  • Location: the app uses your phone’s location when you request or work a job, and shares a mechanic’s position with the customer while they are on the way. Turn it off in phone settings and some things will not work.
  • Disputes with Rollagain itself go to an arbitrator, not a court, one person at a time, no class action. You can opt out by emailing legal@rollagain.app within 30 days of accepting. Small claims court is still open to you. Rollagain’s liability to you is capped (the price of the job, the fees we kept from you in a year, or $500, whichever is greatest); we are not liable for lost loads, downtime or damage to the vehicle, except where the law does not allow such limits.

This summary is for reading. The full text below is the agreement and controls if they differ.

These Terms of Service (the “Terms”) are a binding contract between you and Rollagain LLC, a Delaware limited liability company (in formation) (“Rollagain,” “we,” “us,” or “our”). Until Rollagain LLC is formed, the service is operated by KNAM Media, doing business as Rollagain; “Rollagain,” “we” and “us” mean that operator. They cover the Rollagain website, the mobile web app, the phone and messaging assistants, and the services around them (together, the “Platform”). You accept these Terms and our Privacy Policy when you do any of these: create an account and tap “I agree”; approve a Quote on a Job link we text you; tap “Get a mechanic” on our web form; ask our phone or text assistant to open a request; or otherwise use the Platform. A fleet accepts them for every person it adds. If you do not agree, do not use the Platform, and do not approve a Quote.

What this means: Using Rollagain, approving a price on a link, or sending the web form means you accept these rules and the Privacy Policy. If you do not, do not use it.

Arbitration notice. Section 17 is an arbitration agreement and class action waiver. In plain words: a dispute between you and Rollagain is decided by a private arbitrator, one case at a time, not by a judge or jury and not as a class action, except as Section 17 states. It applies to Customers, fleets, and Service Providers, including any claim that a Service Provider was an employee. You can opt out by emailing legal@rollagain.app within 30 days of accepting these Terms.

1. Definitions

What this means: The words in capitals have fixed meanings. “Locked Price” is the price you approved; “Diagnostic line” is the come-out-and-inspect line of a quote; “Job Record” is the photos, times, GPS and messages we keep.

  • “Customer” means a person or business that uses the Platform to request vehicle repair or roadside service, including drivers, owner-operators, and fleet managers or dispatchers acting for a fleet.
  • “Service Provider” or “Mechanic” means an independent business that uses the Platform to receive Customer requests and perform services.
  • “Job” means a single service request created on the Platform, from request through completion, confirmation, cancellation, or dispute resolution.
  • “Quote” means the itemized price and estimated arrival time a Service Provider sends to a Customer for a Job. The Quote is valid for the time shown on it.
  • “Locked Price” means the total amount of a Quote that a Customer has approved.
  • “Diagnostic line” means the line of a Quote, if it has one, that prices coming out and inspecting the vehicle (in the catalog, “Roadside diagnostic”).
  • “Addition” means a further amount a Service Provider proposes on an approved Job for work that was not in the Quote. It changes nothing unless the Customer approves it.
  • “Job Record” means the photos, timestamps, location data, messages, quotes, approvals, ratings, and other information the Platform stores about a Job.
  • “Service Provider Agreement” means the Mechanic Agreement every Service Provider accepts in the app.

2. What Rollagain is, and is not

What this means: We connect you with an independent mechanic and keep the record. We do not repair, supervise or guarantee the work. We are not 911, not a repair shop and not a tow company; a tow company dispatch names is independent and you pay it directly.

Rollagain is a technology platform that connects Customers who need vehicle service with independent Service Providers, and that records the price, the payment, and the work so both sides can rely on it. In plain words: the mechanic who comes to your vehicle runs their own business. We introduce you, lock the price, hold the payment, and keep the record. Rollagain does not perform, supervise, or guarantee any repair or roadside service. Service Providers are independent businesses. They are not employees, agents, partners, or joint venturers of Rollagain. Rollagain does not set their hours, tell them how to perform work, supply their tools or vehicles, or require them to accept any Job. Each Service Provider decides whether to respond to a request, what to quote, and how to perform the work in accordance with applicable law and industry standards.

For the common services in the Platform’s catalog, Rollagain publishes a price range for each line. That range is a rule Rollagain sets on its own so that a Customer who approves a catalog line knows what it can cost. It is not an agreement among Service Providers, and a Service Provider may quote any work as its own line item at its own price. Rollagain is not a motor vehicle repair shop and not a towing company. It does not diagnose, repair, or move vehicles and does not employ anyone who does. The platform fee is a fee for the use of the Platform, paid by the Service Provider, not a charge for repair.

Rollagain is not an emergency service. If anyone is hurt or in danger, call 911 first. Rollagain does not provide towing or recovery, and does not dispatch service onto the mainline or shoulder of toll highways or other roads where only authorized providers may operate. If you are on such a road, the Platform will direct you to the road authority’s service or to a safe location off the mainline.

Tow companies. Rollagain does not tow, does not hire tow companies, and does not act for them. If a Rollagain dispatcher gives you the name and number of a tow company, or tells one where your vehicle is, that is a referral only. The tow company is an independent business, not Rollagain’s agent or subcontractor. It decides whether to come, when, and at what price. You deal with it directly, agree to its terms, and pay it directly. Rollagain does not check tow companies’ licenses or insurance, makes no promise about them, and is not responsible for anything they do or fail to do, including damage to a vehicle or cargo. You may use any tow company you choose.

3. Eligibility, accounts, and company accounts

What this means: You must be 18, give a real phone number and (for customers) a card. A company is responsible for its drivers’ jobs and pays its monthly invoice by the due date; the driver at the truck still confirms the work.

  • You must be at least 18 years old and able to form a binding contract. The Platform is intended for commercial and business use by drivers, fleets, and vehicle service businesses, and for adults seeking service for their own vehicles.
  • You must provide accurate, current information, including a working mobile phone number and, for Customers, a valid payment method. You are responsible for everything that happens under your account and for keeping your password secure.
  • A fleet may create accounts for its managers and drivers. The fleet is responsible for their use of the Platform and for paying for Jobs they approve.
  • A fleet manager may request a Job for any driver in the fleet and may cancel it. If the fleet has invoice terms with Rollagain, the manager may also approve the Quote. The fleet pays for such a Job. The driver who is with the vehicle is still the person who confirms the work on site.
  • Authority. The person who creates a fleet account, and each manager it adds, confirms that they have authority to bind the business, to add its drivers, and to approve Quotes and Jobs in its name. The business is responsible for every Job requested, approved, or confirmed under its account, including by a driver it added, whether paid by card or on invoice.
  • Invoice terms. Rollagain may grant a fleet monthly invoice terms at its discretion, may limit them to an amount, and may suspend or withdraw them at any time, after which Jobs are paid by card. Rollagain may check the business’s credit and may ask for a credit application, a deposit, or a personal guaranty before granting or continuing terms. A manager who requests invoice terms accepts this Section for the business. Rollagain issues one invoice per month, on the first day of the following month, for the Jobs confirmed on invoice terms in that month. The invoice states its due date and is paid in full by ACH or check to Rollagain LLC, referencing the invoice number. Any question about an invoice must be raised in writing within 30 days after its date; after that it is accepted as issued. A question about one Job goes through Section 9 while that Job is open, or to support within 7 days after its receipt; it does not delay payment of the other Jobs on the invoice. Rollagain issues a credit on the next invoice, or a refund, for any Job it decides in the fleet’s favor. An invoice not paid when due bears a late charge of 1.5% per month, or the highest rate the law allows if lower, from the due date until paid, and the business pays Rollagain’s reasonable costs of collecting it, including attorneys’ fees, where the law allows. Rollagain may suspend the account and require card payment while any invoice is overdue. Ending invoice terms does not cancel amounts already owed.
  • Purchase order numbers. A purchase order number is recorded on a Job as the business types it, for the business’s own accounting. A missing, late, or incorrect number does not excuse or delay payment once the Job was approved on invoice terms.
  • The Service Provider is paid by Rollagain. For an invoice-terms Job, Rollagain pays the Service Provider under the Service Provider Agreement whether or not the business has paid Rollagain. The business’s payment obligation runs to Rollagain.
  • We may suspend or close accounts that violate these Terms, present a safety risk, or are used fraudulently.

4. How a Job works

What this means: You describe the problem; a mechanic sends one price; you approve and your card is held; the mechanic works; you confirm and are charged. Not fixable: only the diagnostic line (and its share of any sales tax). No answer in 24 hours: charged automatically.

  1. Request. The Customer describes the vehicle, the problem, and the location. The Platform shares this with one or more nearby Service Providers.
  2. Quote. A Service Provider sends a Quote with itemized prices and an estimated arrival time. A Quote is valid for the time shown on it: 30 minutes for help now unless it says otherwise, and longer for a visit booked for later or a Job a Service Provider opens for its own customer. A part that cannot be priced before the Service Provider sees the vehicle is shown as its own line, or as a parts allowance (a set amount for parts). Prices shown are the Service Provider’s prices; the Platform adds no surcharge for after-hours service. The Diagnostic line, where the Quote has one, is the price of coming out and inspecting the vehicle. It is owed once the Service Provider arrives and inspects, even if the vehicle cannot be repaired roadside (step 5). The approval screen says so.
  3. Approval and payment hold. When the Customer approves a Quote, the Customer authorizes Rollagain, through our payment processor, to place a hold on the Customer’s card or other payment method for the Locked Price, to keep that payment method on file for the Job, and to charge that amount when the Job is confirmed under step 6 (or the Diagnostic line alone under step 5). A hold is not a charge. It reserves the amount and reduces the balance available on the card until it is released or charged; the bank may show it as “pending”. If the Customer approves an Addition, it is a separate hold on the same payment method. Card holds last a limited number of days. If a hold lapses before the Job is confirmed, the Customer authorizes Rollagain to place it again, or to charge the payment method on file for the approved amount when the Job is confirmed. A hold or charge that fails is a failed payment under Section 5. The Locked Price cannot be increased without a new Quote and a new approval. If the Service Provider finds that more work is needed, they send it as an Addition; the Customer may accept or decline it, and the approved work continues either way. Rollagain collects the Customer’s payment as the Service Provider’s limited payment collection agent. A payment made to Rollagain through the Platform counts as a payment made to the Service Provider, who may not collect it again. The charge appears on the Customer’s statement under Rollagain’s name.
  4. Service. The Service Provider travels to the vehicle, records their arrival, takes photographs before starting and after finishing, and marks the Job done. The Customer must give the Service Provider safe access to the vehicle.
  5. Not repairable roadside. If, after arriving and inspecting the vehicle, the Service Provider finds that it cannot be repaired where it stands, the Service Provider ends the Job on the Platform with a written finding and a photograph of what they found. In that case the Customer is charged only the Diagnostic line of the Quote (for example “Roadside diagnostic”), at the price quoted and never above the published range for that line, plus the part of any sales tax line on the Quote that belongs to the Diagnostic line, at the rate the Quote carried. Every other line, and any Addition approved or still waiting, is withdrawn and not charged. The Customer confirms or disputes that charge as in the two steps below. If the Quote has no Diagnostic line, nothing is charged and the hold is released. Rollagain does not tow; a dispatcher may pass the Customer the name of a tow company as Section 2 describes, at the Customer’s expense.
  6. Confirmation and payment. When the Service Provider marks the Job done, the Platform tells the Customer the amount that will be charged and the deadline. The Customer confirms that the work is done, or opens a dispute. On confirmation, the Locked Price and any approved Additions (or, under step 5, the Diagnostic line alone) are charged to the payment method on hold and the Service Provider’s payout is scheduled. If the Customer neither confirms nor opens a dispute within 24 hours after the Service Provider marks the Job done, the Job is confirmed automatically and the same amount is charged. Doing nothing counts as confirming. It is the amount the Customer approved; nothing else is ever charged. The Platform says this on the approval screen before the Customer approves, on the Job page, and in the message sent when the Job is marked done. Once a Job is confirmed, by the Customer or automatically, Rollagain’s dispute process in Section 9 is closed for that Job, and any claim about the work is between the Customer and the Service Provider. A Customer may still contact support within 7 days about the work, and Rollagain may refund a confirmed Job in whole or in part on the Job Record at its own discretion; that is a courtesy, not an obligation.
  7. Dispute. If the Customer believes the work was not performed as quoted, the Customer may open a dispute on the Platform before the Job is confirmed. Section 9 describes what happens next.

5. Prices, fees, and payment

What this means: Customers pay the locked price and nothing more. Mechanics pay Rollagain 15% on a network job (less on their own customers). Stripe handles cards; we never see your full card number. Paying Rollagain is paying the mechanic. If a payment bounces after the work, you still owe it.

  • Customers pay the Locked Price and any Additions they approve, and nothing else. Rollagain charges Customers no booking fee, no service fee, and no card surcharge. If that ever changes, the fee is shown before approval.
  • Service Providers pay Rollagain a fee on each confirmed Job, deducted from the payout, at the rate in the Service Provider Agreement: 15% of each amount charged for a network Job; 1% plus a card fee of 2.9% + $0.30 per card charge for the Service Provider’s own customer. A sales tax line is not counted in the percentage; the card fee is on the whole charge. The Locked Price and each approved Addition are separate charges; the fee is rounded to the cent on each. Rollagain may change the fee with at least 14 days’ notice; the change applies to Jobs approved after the notice period.
  • Payment agent. Each Service Provider appoints Rollagain as its limited agent to collect payment from Customers for Jobs on the Platform. A Customer’s payment to Rollagain for a Job is payment to the Service Provider for that Job, and satisfies the Customer’s obligation to the Service Provider to that extent, even if Rollagain has not yet paid the Service Provider. If the payment is later reversed, the obligation is restored.
  • Payments are processed by Stripe, Inc. (“Stripe”) under Stripe’s privacy policy. Service Providers receive payouts through Stripe Connect and agree to the Stripe Connected Account Agreement, including the Stripe Terms of Service, and must complete Stripe’s identity and bank verification before receiving payouts. Rollagain does not store full card numbers.
  • A hold is not a charge. When a Job is cancelled or refunded, the hold is released at once on our side, but the Customer’s bank may keep showing it as “pending” for several days. That is the bank’s timing, not a second charge, and Rollagain cannot speed it up.
  • Sales tax. If sales tax applies to a Job, the Service Provider must include it as its own line on the Quote, so it appears on the receipt. Service Providers are responsible for collecting, reporting, and remitting sales tax on the services and parts they provide, and for their own income and self-employment taxes. Where the law makes Rollagain the collector, Rollagain collects and remits it and says so on the Quote or the receipt. Customers are responsible for any tax not collected on the receipt.
  • Failed or reversed payments. If a payment fails or is reversed after the service was performed, the Customer still owes the Locked Price. Rollagain may collect it by charging any payment method on file, by deducting it from future payouts if the Customer is also a Service Provider, or by any other lawful means, and may add reasonable collection costs where the law allows.
  • Refunds. A refund decided under Section 9, or made by Rollagain for any other reason, goes back to the payment method that was charged, or is credited against the company’s invoice. Rollagain does not refund amounts paid to anyone outside the Platform, such as a tow company.
  • Reversed payments (Service Providers). If a Customer’s bank reverses a payment for a Job after you were paid, and the Job Record does not defeat the reversal, you owe Rollagain the reversed amount and any network fee, as the Service Provider Agreement states. Rollagain may deduct it from your future payouts or, under your Stripe agreement, from your Stripe balance, and will show you the Job Record it relied on.
  • The payment processor. Rollagain does not control when the payment processor holds, delays, reserves, or refuses a payout under its own rules, and is not responsible for it. For card Jobs, Rollagain never holds funds itself outside the processor. A company on invoice terms pays Rollagain directly (Section 3).

6. Cancellations

What this means: Free before you approve, free until two hours before a booked visit, free if the mechanic is 15+ minutes late. Otherwise cancel through dispatch; only the travel or diagnostic line already on your quote can be charged, paid to the mechanic.

  • Before you approve a Quote: cancel at any time, at no charge, on the Platform.
  • Booked visits: cancel at no charge on the Platform until two hours before the window begins, even after approval; any hold is released. Inside those two hours, cancellation is through Rollagain dispatch and the rules below for a Job under way apply.
  • A late Service Provider: if the Service Provider is past the arrival time on the Quote by the margin the Platform uses (currently 15 minutes), the Platform tells you and you may cancel at no charge on the Platform. The hold is released.
  • After you approve, before the Service Provider arrives: cancellation is through Rollagain dispatch (Section 20), which applies these rules. If the Service Provider was already on the way, Rollagain may charge the travel line shown on the approved Quote, if there is one, and pay it to the Service Provider. Nothing else is charged. If the Quote has no travel line, nothing is charged.
  • After the Service Provider arrives: if you decline to proceed for reasons unrelated to the Service Provider’s conduct, the Diagnostic line on the approved Quote, if there is one, may be charged and paid to the Service Provider, with the part of any sales tax line that belongs to it. Nothing else is charged. If the Quote has no Diagnostic line, nothing is charged.
  • Not repairable roadside: Section 4, step 5 applies.
  • A Service Provider who accepts a Job and does not go, or does not arrive within a reasonable time without notice, may lose access to the Platform.
  • Rollagain may cancel any Job for safety, fraud, or legal reasons. No charge applies and any hold is released.

7. Service Provider obligations

What this means: Mechanics are independent businesses with their own licenses, insurance, tools and taxes. They quote first, do only the approved work, take the photos, and never take cash on the side.

By registering as a Service Provider you represent and agree that, at all times while using the Platform, you:

  • operate a lawful, independently established repair business, and hold every license, registration, or permit required by the states and localities where you work (for example, a state repair-shop registration or repairer’s license where your state requires one), and will upload proof and keep it current;
  • maintain, at your own expense, the insurance the Service Provider Agreement requires, and upload current certificates of insurance;
  • supply your own tools, parts sources, vehicle, and personnel; set your own schedule, service radius, and prices (Section 2 describes the catalog ranges); are free to accept or decline any request; and may work for other platforms and clients;
  • will send a Quote before performing work, perform only the work quoted and approved, take the required before-and-after photographs, and record arrival and completion truthfully;
  • will not solicit or accept off-Platform payment for a Job that began on the Platform, and will not ask a Customer to cancel a Job in order to complete it off-Platform;
  • are solely responsible for the quality and safety of your work, for any warranty you offer, for your employees or helpers, who are your employees or contractors and never Rollagain’s and for whom you carry workers’ compensation insurance where the law requires it, and for complying with all laws, including consumer protection, environmental, and workplace safety laws;
  • are an independent contractor for all purposes, will receive an IRS information return where required, and are not entitled to wages, benefits, unemployment insurance, or workers’ compensation from Rollagain. Nothing in these Terms creates an employment, agency, franchise, or partnership relationship (in plain words: you are not our employee, and we are not your boss, partner, or franchisor);
  • will treat Customer personal information received through the Platform as confidential and use it only to perform the Job.

8. Customer obligations

What this means: Give a true location and vehicle, answer your phone, give safe access, keep your job link private, and confirm or dispute when the job is marked done.

  • Provide accurate vehicle and location information, be reachable at the phone number on your account or your Job, and give the Service Provider safe access to the vehicle.
  • Confirm you own the vehicle or are authorized by its owner or operator to request service on it. If you request service for a business, or for a vehicle you do not own, you confirm that the owner or the business authorized you to request the work, approve the price, and confirm the work.
  • The Quote is the written estimate, your approval is your written authorization of that work at that price, and the receipt is the itemized invoice. If the law where the work is done gives you a right to the parts that were replaced, tell the Service Provider before the work starts.
  • Keep your Job link private. Anyone who has it can see the Job and act on it.
  • Do not ask a Service Provider to perform work off-Platform for a Job that began on the Platform.
  • Review the Job when the Service Provider marks it done. Confirm it if the work matches the Quote; open a dispute if it does not.

9. Disputes between Customers and Service Providers

What this means: Report a problem before the 24 hours end; the money stays held. Rollagain decides on the record, normally within 48 hours; that is final for the money held on this job. You keep your other legal rights against the mechanic and your card rights.

If a Customer opens a dispute, the Locked Price stays on hold and is not released to the Service Provider. The Service Provider may respond on the Platform. Rollagain reviews the Job Record, including photographs, timestamps, and location data, and decides, normally within 48 hours, whether to release the Locked Price to the Service Provider, refund it to the Customer, or split it. Rollagain’s decision is final for one thing only: the money held on the Platform for that Job. Rollagain may rely on the Job Record to decide. This process does not take away any other legal right you have against the other party, and it does not make Rollagain responsible for the work or for any damage.

Two days after a Job is confirmed, Rollagain may text the payer to ask whether the vehicle is still running, and a dispatcher may call if the answer is no. The check-in is a courtesy. It is not a warranty by Rollagain, it does not reopen the payment for the Job, and it does not extend the dispute window. Any warranty on the work is the Service Provider’s.

Customers agree to report a problem through this process first, before asking their bank for a chargeback. Nothing in these Terms takes away a right you have under your card agreement or the law. If a chargeback is opened, Rollagain gives the Job Record (photos, times, GPS) to the payment processor in answer to it and may close the Platform dispute for that Job.

10. Job Records, photographs, ratings, and content

What this means: We keep the job’s photos and data and may show them to the payment processor, insurers or authorities. You let us use what you upload to run the service. Ratings only from real paid jobs; a mechanic may rate you too, and you can ask what is held against you.

  • The Platform creates a Job Record for every Job. Both parties to a Job may view the Job Record. Rollagain may share it with the payment processor, insurers, and authorities as described in the Privacy Policy.
  • In plain words: the photos and ratings you upload stay yours, and you let us store and show them to run the service and settle disputes. You grant Rollagain a non-exclusive, worldwide, royalty-free license to store, display, and use the photographs, ratings, and other content you submit for the purposes of operating the Platform, resolving disputes, and improving the service. You are responsible for content you submit and represent that you have the right to submit it.
  • Ratings and reviews may be left only by the parties to a completed, paid Job and must be truthful and unpaid. A rating or review is the opinion of the person who left it. Reviews shown on a Service Provider’s public page come from Customers of completed, paid Jobs; Rollagain does not check them beyond that. Rollagain may remove content that is false, abusive, or unlawful.
  • Ratings of Customers. After a Job, a Service Provider may rate the Customer with stars and a short note. For a Customer without an account, the rating is kept against the mobile number on the Job. Other Service Providers see the average and the count only; the note is seen by Rollagain and by the Service Provider who left it. Ratings are not shared outside the Platform, are not sold, and are not used for credit, insurance, or employment decisions. Rollagain may look at a low rating together with the Job Record before serving a Customer again, but does not refuse service on a rating alone. You may ask what rating is held against your account or number, and ask us to review one you believe is false, by emailing privacy@rollagain.app. We remove a rating that is abusive or that the Job Record shows to be untrue.
  • Numbers people type. Odometer readings, purchase order numbers, unit numbers, and maintenance reminders are recorded as a person typed them or as a fleet’s telematics reported them. Rollagain does not verify them, and a fleet’s maintenance decisions remain the fleet’s.

11. Location, phone calls, and text messages

What this means: We use your phone’s location during a job. Texts are optional: STOP ends them, HELP helps. Calls are answered by an assistant, recorded and transcribed. Phone numbers are shared only after a price is approved.

  • Location. The Platform uses your device’s location when you request or perform a Job so the parties can find each other and so the Job Record is accurate. While a Service Provider is on the way, the Platform shares their position with the Customer until they arrive. You can disable location in your device settings, but the Platform may then be unable to create or complete Jobs.
  • Text messages. Rollagain sends automated transactional text messages about your Jobs and your account: the link to your Job, quotes, arrival and delay updates, completion and payment notices, a reminder for a booked visit, and one check-in two days after a Job. You consent to those messages when you check the text-message box at signup or in your account settings, give your mobile number on the “Get a mechanic” form and tap the button, text us first, or give your number to our phone assistant and agree to receive the link. A Service Provider who opens a Job for its own customer confirms that the customer gave the number for that Job and agreed to be texted about it. Message frequency varies with your activity. Message and data rates may apply. Consent is not a condition of buying anything. Reply STOP to any message to stop texts and HELP for help; you may also withdraw consent by any reasonable means, such as emailing support@rollagain.app. Help: support@rollagain.app or rollagain.app/support. Replying STOP ends the texts, not the Job: every update still shows on your Job page, though without texts you may see it later. Rollagain does not send marketing texts.
  • Phone calls and the assistant. Calls to Rollagain’s number are answered by an automated assistant, which says so at the start of the call. Calls are recorded and transcribed, and your messages to the assistant by text or messaging app are kept, so that the Job Record is accurate, to check and improve the assistant, and for safety and quality. Say “dispatcher” at any time to reach a person. Nothing the assistant says is a price, a promise of an arrival time, a diagnosis, or a change to these Terms.
  • Phone numbers are shared between a Customer and a Service Provider only after a Quote is approved, and only for that Job.

12. Prohibited conduct

What this means: No fake jobs, fake photos, harassment, hacking, or using our data to build a rival service. Working for other platforms is fine.

You agree not to: use the Platform for any unlawful purpose; misrepresent your identity, licensing, insurance, or the condition of a vehicle; create fake Jobs, quotes, or ratings; harass, threaten, or discriminate against anyone; access another user’s account or data; scrape, reverse engineer, or interfere with the Platform; upload malicious code; or use the Platform’s software, data, or the Customer information you received through it to build or run a competing service. Working for other platforms and clients is allowed.

13. Intellectual property

What this means: The app, name and logo are ours. You may use the app for its purpose and nothing else.

14. Disclaimers

What this means: The app is provided as is. We do not promise a mechanic will come, arrive on time or fix the truck. Roadsides are dangerous. Checking a mechanic’s documents is not a guarantee of their skill.

In plain words: we cannot promise that a mechanic will be free, arrive on time, or fix your vehicle, and we are not on site. The mechanic is responsible for the work. A roadside is a dangerous place; please follow the safety steps in the app and call 911 when in doubt.

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, ROLLAGAIN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ROLLAGAIN DOES NOT WARRANT THAT ANY SERVICE PROVIDER WILL BE AVAILABLE, ARRIVE ON TIME, OR PERFORM WORK CORRECTLY, OR THAT ANY REPAIR WILL FIX A VEHICLE. SERVICE PROVIDERS ARE SOLELY RESPONSIBLE FOR THEIR WORK. ROADSIDES ARE DANGEROUS. YOU ACCEPT THE RISKS THAT COME WITH BEING AT A ROADSIDE OR WORKSITE, SUCH AS PASSING TRAFFIC, WEATHER, AND UNEVEN GROUND. OUR AUTOMATED ASSISTANT AND DISPATCHERS MAY REPEAT COMMON ROADSIDE SAFETY PRACTICES AND ROAD AUTHORITIES’ RULES. THAT IS GENERAL INFORMATION, NOT ADVICE FOR YOUR SITUATION; YOU DECIDE WHAT IS SAFE, AND YOU CALL 911 WHEN IN DOUBT. ANY PROBLEM CATEGORY, TRIAGE, OR “IT COULD BE” FROM THE ASSISTANT IS A GUESS TO HELP A SERVICE PROVIDER PREPARE, NOT A DIAGNOSIS. ARRIVAL TIMES ARE ESTIMATES. ONLY A SERVICE PROVIDER’S WRITTEN QUOTE ON THE PLATFORM IS A PRICE. A RATING OR REVIEW IS THE OPINION OF THE PERSON WHO LEFT IT. VERIFICATION OF A SERVICE PROVIDER’S DOCUMENTS IS A REVIEW OF DOCUMENTS SUBMITTED TO US AND IS NOT A GUARANTEE OF THEIR SKILL, HONESTY, OR CONTINUED INSURANCE COVERAGE.

15. Limitation of liability

What this means: If something goes wrong, the most Rollagain owes you is the price of the job, the fees you paid us in the last year, or $500, whichever is greatest. No lost loads, downtime or vehicle damage, except where the law does not allow that limit.

In plain words: if Rollagain is at fault, the most we owe you is the locked price of the Job, the platform fees we kept from you in the last twelve months, or $500, whichever is greatest. We do not pay for lost loads, lost income, downtime, or damage to the vehicle. This does not limit what the law does not allow us to limit, such as our own fraud or gross negligence. Some states do not allow these limits, so they may not all apply to you.

TO THE FULLEST EXTENT THE LAW ALLOWS, ROLLAGAIN AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST LOADS OR CARGO, LOST REVENUE, DOWNTIME, DETENTION OR LAYOVER COSTS, OR DAMAGE TO A VEHICLE, ARISING OUT OF OR RELATED TO THE PLATFORM, ANY JOB, ANY SERVICE PROVIDER, ANY TOW COMPANY, OR ANY GUIDANCE FROM OUR AUTOMATED ASSISTANT OR DISPATCHERS, EVEN IF ADVISED OF THE POSSIBILITY. FOR A SERVICE PROVIDER, THIS INCLUDES LOSSES FROM A REQUEST OFFERED TO MORE THAN ONE SERVICE PROVIDER, A WITHDRAWN OR EXPIRED OFFER, A CANCELLED JOB, A PAUSED OR CLOSED ACCOUNT, OR A DELAY BY THE PAYMENT PROCESSOR. ROLLAGAIN’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE PLATFORM WILL NOT EXCEED THE GREATER OF (A) THE LOCKED PRICE OF THE JOB THAT GAVE RISE TO THE CLAIM, (B) THE PLATFORM FEES ROLLAGAIN KEPT FROM YOU IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (C) 500 U.S. DOLLARS. THESE LIMITS DO NOT APPLY TO LIABILITY THAT THE LAW DOES NOT ALLOW TO BE LIMITED, INCLUDING LIABILITY FOR ROLLAGAIN’S OWN FRAUD, GROSS NEGLIGENCE, OR WILLFUL MISCONDUCT, OR FOR DEATH OR PERSONAL INJURY CAUSED BY ROLLAGAIN’S OWN NEGLIGENCE WHERE THE LAW DOES NOT ALLOW THAT TO BE LIMITED. SOME STATES DO NOT ALLOW SOME OF THESE LIMITS, SO SOME MAY NOT APPLY TO YOU.

16. Indemnification

What this means: If your use of the app, your work or your vehicle causes a claim against Rollagain, you cover our costs, unless we were grossly negligent.

In plain words: if something you did (your work, your vehicle, your breach of these Terms) leads to a claim against Rollagain, you pay our costs, including lawyers’ fees, unless the claim was caused by our own gross negligence or willful misconduct.

You will defend, indemnify, and hold harmless Rollagain and its owners, officers, employees, and agents from any claims, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to: your breach of these Terms; your violation of law; for Service Providers, the services you perform, your personnel, your vehicles, your failure to hold required licenses or insurance, and any text or call Rollagain sent on your word that a customer agreed to it; and for Customers, the vehicle, the location, and any injury or damage caused by you or your personnel. This does not apply to the extent a claim was caused by Rollagain’s own gross negligence or willful misconduct. Rollagain will tell you promptly of a claim it asks you to cover, will let you control the defense with counsel Rollagain does not reasonably object to, and will not settle it without your consent unless Rollagain pays the whole settlement. You will not settle a claim in a way that admits fault by Rollagain or binds it without Rollagain’s written consent.

17. Arbitration agreement and class action waiver

What this means: Disputes with Rollagain go to a private arbitrator, one person at a time. No judge, no jury, no class action. We talk for 60 days first. Opt out by email within 30 days. Small claims court still allowed.

Please read this section carefully. It affects your legal rights. It applies to Customers, fleets, and Service Providers, and to the Service Provider Agreement. In plain words: if you and Rollagain cannot settle a dispute in 60 days of talking, a neutral arbitrator decides it, not a court. Arbitration is private, one case at a time, and its decision is binding. You give up a trial before a judge or jury and any class action. Small claims court stays open. You can opt out within 30 days by emailing legal@rollagain.app.

(a) What we agree to arbitrate. You and Rollagain agree that any dispute, claim, or controversy between you and Rollagain (or its owners, officers, employees, agents, or affiliates) that arises out of or relates to these Terms, the Service Provider Agreement, the Privacy Policy, the Platform, any Job, or any communication between us, whether based on contract, tort, statute, fraud, misrepresentation, or any other legal theory, and whether it arose before or after you accepted these Terms, will be resolved by binding arbitration on an individual basis and not in court. This includes any claim that a Service Provider was an employee rather than an independent contractor. The exceptions are in paragraph (c).

(b) Who decides what. The arbitrator, and not any court, has the exclusive authority to decide any dispute about the interpretation, applicability, enforceability, scope, or formation of this Section 17, including whether any part of it is void or voidable and whether a claim falls within it. Two things are for a court: whether the class action waiver in paragraph (e) can be enforced, and any dispute about paragraph (j).

(c) Exceptions. Either party may bring an individual claim in small claims court if it qualifies there and stays individual. Either party may ask a court for an order to protect its intellectual property or to stop unauthorized access to or use of the Platform. Nothing here stops you from reporting anything to a government agency or stops that agency from acting on it.

(d) Jury waiver. By agreeing to arbitrate, you and Rollagain each give up the right to have a dispute decided by a judge or jury in court, and the right to appeal, except as the Federal Arbitration Act allows. Discovery in arbitration is more limited than in court.

(e) Class action waiver. You and Rollagain each agree to bring claims only in your own individual capacity, and not as a plaintiff or member of any class, collective, consolidated, private attorney general, or representative proceeding. The arbitrator may not consolidate more than one person’s claims, may not preside over any class or representative proceeding, and may award relief, including injunctive relief, only in favor of the individual party seeking it and only as far as needed to resolve that party’s individual claim. If a court finds that this paragraph cannot be enforced for a particular claim or request for relief, that claim or request will be decided in court, and it will be stayed until every other claim has been arbitrated. The rest of this Section 17 continues to apply.

(f) Rules, administrator, and governing law. The arbitration is administered by the American Arbitration Association (“AAA”) under its rules in effect when the arbitration is filed, as changed by this Section: the Consumer Arbitration Rules for a Customer who is an individual using the Platform for personal, family, or household purposes, and for a Service Provider who is an individual or the owner of a business with no employees; the Employment/Workplace Arbitration Rules for any claim that a Service Provider was an employee of Rollagain; and the Commercial Arbitration Rules for every other party, including fleets and companies. The rules are at www.adr.org. If the AAA cannot or will not administer the arbitration, the parties will agree on another administrator, and a court will appoint one if they cannot. This Section is governed by the Federal Arbitration Act. If a court finds that the Federal Arbitration Act does not apply to a party or a claim, the arbitration law of the State of Delaware applies to it instead.

(g) Before filing: a written notice and 60 days to talk. Before either side starts arbitration or a small claims case, it sends the other a written notice of dispute saying what the claim is and what it wants. A notice to Rollagain goes to legal@rollagain.app and to the mailing address in Section 20. A notice to you goes to the email and mobile number on your account or your Job. The notice must give the name, the account email or the phone number and Job code, a description of the claim and the facts behind it, the relief sought and the amount, and, for an individual, that person’s own signature (a lawyer may sign in addition, not instead). Both sides then try in good faith to settle it for 60 days after the notice is received, and either may ask for a phone or video call during that time. Arbitration may be started only after those 60 days. Any deadline for bringing the claim is paused while this paragraph is being followed. If a party starts arbitration without completing this paragraph, the AAA or the arbitrator will pause the case until it is completed.

(h) Where and how. The arbitration takes place in the county where you live or, for a business, where it is based, or by video or phone if you prefer or the rules allow. A claim for $25,000 or less may be decided on documents alone as the rules allow. The arbitrator applies the law stated in Section 18 and the same statutes of limitation and privileges a court would, may award the same individual relief a court could, and gives a short written explanation of the award on request. A court with jurisdiction may enter judgment on the award.

(i) Fees. AAA fees are set by its rules. Under the Consumer Rules and the Employment/Workplace Rules, you pay the filing fee those rules set for you, and Rollagain pays the rest of the AAA filing, administrative, and arbitrator fees. If the arbitrator finds that a claim was frivolous or filed for an improper purpose, the arbitrator may make the party that filed it pay those fees and the other party’s reasonable attorneys’ fees, as a court could. Otherwise each party pays its own attorneys’ fees, except where a statute or this agreement lets the arbitrator award them. Rollagain will not seek its attorneys’ fees or costs from an individual unless the arbitrator finds that individual’s claim frivolous or made in bad faith. Under the Commercial Rules, fees are shared as those rules state.

(j) Many similar claims. If 25 or more demands for arbitration are filed against Rollagain, or by Rollagain, raising similar claims and with the same or coordinated lawyers, they are “coordinated cases” and this paragraph applies. (1) The AAA’s Mass Arbitration Supplementary Rules apply, as changed here, and Rollagain’s obligation to pay fees is limited to what those rules require. (2) Each side’s lawyers select 10 coordinated cases (20 in all) to be filed and decided first, one arbitrator per case. AAA fees for the other coordinated cases are not due, and those cases are not filed, until the first 20 are decided. (3) When the first 20 are decided, the parties must try in good faith, for 60 days, with a mediator the AAA appoints, to resolve the remaining coordinated cases, using the first results as guidance. (4) If they do not all resolve, the remaining coordinated cases proceed in batches of 50 before one arbitrator per batch, each case decided individually on its own record, and the batches proceed in sequence. (5) Every deadline for a coordinated case is paused from the day the first notice of dispute in the group is received until that case is resolved. (6) A court, not an arbitrator, decides any dispute about this paragraph. If a court finds this paragraph cannot be enforced, the rest of this Section 17 still applies and the coordinated cases proceed under the AAA’s Mass Arbitration Supplementary Rules.

(k) Opt out. You may opt out of this Section 17 by emailing legal@rollagain.app within 30 days after you first accept these Terms (or, for a Service Provider, within 30 days after you first accept the Service Provider Agreement, if later). Send it from your account email or, if you have no account, from any email that states the phone number on your Job; state your name and that you opt out of arbitration. An opt-out applies to both you and Rollagain, and only to you. It does not affect any other part of these Terms.

(l) Changes. If Rollagain changes this Section 17 after you accept it, you may reject the change by emailing legal@rollagain.app within 30 days after it takes effect; if you do, the version you last accepted applies. A change does not apply to a dispute you have already given notice of or filed.

(m) Survival and severability. This Section 17 survives the closing of your account, the end of these Terms or the Service Provider Agreement, and the completion of any Job. Except as paragraphs (e) and (j) state, if any part of this Section is found unenforceable, that part is severed and the rest still applies.

18. Governing law and venue

What this means: Delaware law applies. Anything not sent to arbitration goes to a Delaware court, except small claims where you live and where your own state’s law lets you sue there.

These Terms and any dispute between you and Rollagain are governed by the laws of the State of Delaware and by the Federal Arbitration Act, without regard to conflict-of-law rules, regardless of where you live or where a Job takes place. If you are a consumer, this choice of law does not take away any protection given to you by the law of the state where you live that cannot be waived by contract. For any matter not subject to arbitration, you and Rollagain agree to the exclusive jurisdiction of the state and federal courts located in Delaware, except that a qualifying small claims case may be brought in the county where you live or do business, and except where the law of the state where you live gives you the right to sue there.

19. Changes, termination, and general terms

What this means: We may change these Terms with 14 days’ notice; if you disagree, close your account first. Tapping a button is your signature. We are not responsible for weather, road closures or outages we do not control.

  • We may update these Terms. Material changes take effect 14 days after we post them on the Platform or notify you, except that changes to Section 17 follow paragraph (l) of that Section. If you keep using the Platform after the new Terms take effect, you accept them. If you do not agree, close your account before that date.
  • You may close your account at any time from the account page or by emailing support@rollagain.app. Open Jobs and amounts owed survive closure. Sections 5, 7 (except duties that apply only while you use the Platform), 9, 10, and 13 through 20 survive termination, together with any amount owed.
  • These Terms, the Privacy Policy, the Service Provider Agreement for Service Providers, and any Job-specific terms shown on the Platform are the entire agreement between you and Rollagain about the Platform. If the Service Provider Agreement conflicts with these Terms, it controls for Service Providers. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms. Rollagain may assign them, together with the Job Records, to Rollagain LLC once it is formed, to an affiliate, or to a successor to the business. Notices to you may be given by email, text, or on the Platform. Notices to Rollagain go to legal@rollagain.app and to the mailing address in Section 20, and count as received when the email is sent or three days after mailing.
  • Electronic records and signatures. You agree that Rollagain may give you Quotes, approvals, receipts, invoices, notices, and these Terms electronically, on the Platform, by text, or by email, and that tapping a button on the Platform is your signature. You need a device with a web browser, an email address or mobile number, and the ability to save or print a page. You may withdraw this consent and close your account by emailing support@rollagain.app; a withdrawal does not affect Jobs already done. You may ask for a paper copy of a receipt at that address.
  • Events outside our control. Rollagain is not responsible for delay or failure caused by events outside its reasonable control, such as weather, road closures, outages of carriers, hosting or payment providers, or acts of government.
  • Accessibility. If you cannot use part of the Platform with assistive technology, email support@rollagain.app or call the dispatch number, and a person will take your request another way.
